Judicial Literacy for Generation Z: Reshaping Justice and Civic Participation in a Digital Age.

Abstract: In the age of digital activism and globalization, Generation Z stands at the forefront of social change and is uniquely positioned to reshape the landscape of justice and civic participation. The objective of this article is to present multiple perspectives on the need for judicial literacy for those who are longing for justice. By equipping this generation with the tools to understand and influence the justice system, society can nurture more informed, active, and empowered citizens, as the future of justice is in their hands.

Judicial Literacy for Generation Z: Reshaping Justice and Civic Participation in a Digital Age

Introductory Input

The Indian judicial system is an integrated system headed by the Supreme Court, with High Courts at the state level, district courts, and other subordinate courts at the lower levels [1,2]. It is an independent branch of government responsible for interpreting the Constitution, resolving disputes, protecting citizens' rights, and acting as a check on the executive and legislative branches. The system handles both civil and criminal cases, aiming to deliver justice impartially and uphold the rule of law by administering both central and state laws.  Civil cases involve disputes between individuals or entities, such as contract breaches or divorce, while criminal cases involve crimes like murder or robbery. The judiciary can review laws and the government’s actions to ensure they are in accordance with the Constitution. The judiciary's primary function is to deliver justice to the people by resolving disputes and punishing offenders. It protects the fundamental rights of citizens and ensures the government does not exceed its powers. It serves as a vital check and balance on the powers of the legislature and executive, ensuring they stay within their designated roles and responsibilities. 

General disorder in the neighborhood leads to increased antisocial behavior, which ultimately results in serious crime and lawbreaking. If a civil disorder is eliminated, then grave crimes will drop, and it is crucial to explore the right perspectives on the judicial system and issue directions for nationwide compliance with regulations to signal seriousness about diverse offences. Truth is subject to confirmation or contradiction on inquiry. Veiling power hides the real (manipulates truth), and projection power reveals other things than the real (creates an illusion). There are several issues and concerns in law-making and its enforcing bodies [3,4]. These challenges include the following: i) frequent disturbances disrupting proceedings, ii) forced adjournments for several days at a stretch, iii) heavy absenteeism witnessed in the parliament, iv) public servants becoming the source of power and patronage with vested interests, and v) essential bills not moved due to various reasons. 

It is essential to enhance the quality of people elected to the parliament, as an alert and intelligent public opinion matters in the nation-building task. People must take an active part in the political process/decision-making, and elected representatives must take practical actions considering public moods and mass aspirations. At the same time, establishing fast-track courts, mobile courts, rural courts, or special courts would help provide timely justice to the victims and prevent unlawful activities. Similarly, judicial education, trial court practice, and training, as well as rooting out judicial corruption, are crucial in the long-term public welfare and progress [5]. Directing the energy of the younger generation, Gen Z, into constructive channels fosters lasting social changes. The awareness programs on judicial literacy involving people’s participation using improved technology will encourage them to engage in lawful activities. Lawyers should act as a strong force in society’s reformation in the letter and spirit of the law. We must create an environment where lawyers understand their contribution to the larger picture, offer mental health support, and provide opportunities for mentoring/mediation. 

Upholding Legal Principles

Foundational concepts that guide the interpretation and application of laws, ensuring fairness, justice, and consistency in legal systems, are called legal principles. The key legal principles include the rule of law, separation of powers, and equality. The rule of law ensures that everyone in power is subject to and accountable under the law, promoting fairness and preventing misuse of power. The separation of powers divides legislative, executive, and judicial authority to prevent one branch from becoming too powerful. Treating all individuals equally under the law is an important principle. The concept of legal certainty ensures that laws are transparent, predictable, and consistently applied to ensure fairness and avoid confusion. The hierarchy of legal norms establishes a ranking of legal rules in the order of constitutions, statutes, regulations, and judicial precedents. The principle of legality implies that actions can only be punished if they are prohibited by law. Other essential principles include fairness, justice, accountability, proportionality, responsibility, precedent, contract, administration of justice, and alternative liability [6,7].

To stimulate reliable judgment, the sequence of concrete action steps should be logical (particular subject areas), the proper people should be involved (specialized expertise or experience), and the deadlines should be reasonable to rationalize specific reasons to complete quickly (time management). Passion is the energy that drives excellence and superior results in real-world legal scenarios. It is essential to motivate and inspire young learners to help them maximize their potential to lead more stable, productive lives. It is essential to shift people’s mindset from negative to positive thinking and strive towards the ideals of social justice and harmony. It is better to curb some social issues, such as nepotism, favoritism, racism, casteism, terrorism, separatism, regionalism, sexism, linguism, exclusivism, communism, capitalism, socialism, authoritarianism, and religious fundamentalism, that turn humans against each other. The deliberate misuse of power/authority by targeting various corporate entities or politicians to extort money with criminal intent is against the interests, goals, and values of society. Terrorism is a persistent challenge to the sustainable development of nations. It is vital to expedite the delivery of justice, as justice delayed is indeed justice denied. A speedy trial is a fundamental right, especially in important criminal and sensitive cases. A proper legal perspective on biomedical waste management, environmental/biodiversity protection, pollution prevention and control, corruption control, and the making/breaking of laws has a profound impact on societal reform in the right spirit. The transition from prison inmate to a contributing citizen via reintegration into society, rehabilitation, and reformation is essential for the greater good of society [8,9]. Free electricity/bus service, cheap rations, subsidies, loan waivers, and other freebies left people dependent rather than empowered, and entitlement rather than contribution. A politics of paralysis and entitlement, creating permanent vote banks, could only lead to short-term gains at the cost of long-term development. The judicious choice of democratic representatives by youngsters and court judgements on quality education, productivity, innovation, digital governance, entrepreneurship, sustainable development, civic nationalism, infrastructure, and technology-driven inclusion can drive true empowerment with rights and responsibilities.       

Spirit of Justice System  

If our rules and specific regulations are poorly drafted, possible multiple interpretations make the matter more complicated, often leading to disputes and litigation in the justice delivery system. No timely justice, judicial corruption, misconduct by judges, misuse of laws, money laundering, anti-national activities, inflammatory speeches, terror, civil disorder, injustice and crimes, disproportionate assets, deepfakes, civic sense issues, and organized crime often lead to senseless violence and pose a significant danger to a healthy society. Activities of organized crime include gambling, money laundering, narcotics distribution, prostitution, kidnapping for ransom, human trafficking, bank robberies, drug trafficking, destructive arson, illegal sale or distribution of firearms, illegal land hoarding, mass murders, public property damage, smuggling, and blackmail. Sometimes, we must agree to disagree to demonstrate tolerance for conflicting viewpoints that are more relevant than ever before. Strife and struggle, tension and turmoil, shooting and looting, suffering and suffocating, hatred and violence, dissonance and injustice, war and loss of dignity, civil disorder and crime, terror and trafficking must be significantly reduced by working towards ideals of social justice and harmony using body, mind, and intellect. Other critical concerns include terrorism, cybercrime, public health legislation, torture behind bars, capital punishment, accident cases, cheque bounce cases, tax evasion, financial fraud, illegal immigration, digital arrest scams, ragging, transnational disputes, and redefining environmental jurisprudence [8,9]. A broad network involving politicians and bureaucrats that manages illicit funds and conspires to conceal them is a contemporary challenge and a pressing societal need. Addressing this issue requires greater transparency, stronger legal frameworks, and effective enforcement mechanisms to ensure accountability and restore public trust.

Reflections on the Judicial System 

Humongous delays in conviction, low conviction rates, absence of witness protection programs, hostile witnesses, faulty investigations, and misuse of laws results in the pendency of cases and mockery of justice. It is essential to create public awareness of various laws for an orderly society devoid of evil and injustice. Better policing, speedy justice, stringent punishments, independence of institutions, public interest litigation, and preventive measures can have a powerful impact on people and help avoid legal problems. Environmental degradation, the content/conduct of government policy, violation of fundamental human rights of the poor, violation of religious or other fundamental rights, and compelling municipal people to perform a public duty are essential for changes in society or social welfare. Exploiting technicalities, loopholes, and ambiguous language of laws will spoil the very intention of why the law was enforced.  It is paramount to develop a professional culture (attorney/judge) as there is no replacement for experience/competitive edge/quality judgment. Rational thinking, innovative strategies, peaceful protests, sustainable judicial practices, raising voices against injustice, preventing future legal issues, transparency/accountability/responsibility, social activism, and novel technologies make things better and have a positive impact on other people’s lives. It is better to comply with not just the letter of the rules and regulations but also the spirit behind why these rules had to be implemented. Sensitizing the general public about the laws of the land is vital to maintaining discipline and order in society. In a just society, the principles of accessibility and access to healthcare, opportunities, and justice that empower people to lead dignified lives are significant [10].

Reforms in the Legal Field

We must reform the legal system by realizing the following: i) the need to fight for justice/democratic values, ii) pay extra attention to social well-being, iii) young adults must enter politics in large numbers, iv) be more active in terms of citizen participation, v) demand our parliamentarians to contribute to social welfare schemes, vi) embrace the modern scientific thinking and hard-work culture and, vii) use natural resources sustainably and become a prosperous, harmonious democracy. The journey to success depends on how we learn to identify root causes and acknowledge and navigate these challenges with courage and grace, unified efforts, and collective humanity, leading to achievement. Ultimately, fostering a scientific culture that values scientific spirit, diverse perspectives, and integrity over pseudoscience and sycophancy is essential for the long-term health of the nation and the public welfare. Purpose and passion, policies and schemes for public welfare, training, and certification, quick decision-making and rapid implementation, and developing a deeper connection with our natural ecosystem help create future-ready learners/professionals. Artificial intelligence is transforming our society, and legal professionals are leveraging AI-powered tools for different tasks, including legal knowledge/research, reasoning, predictive analytics, decision-making, and contract review. Future-ready solutions incorporate the availability and access to legal services, innovative models to provide practical and affordable legal services, online legal consultancy and other services, and free legal assistance for senior citizens. All stakeholders of democracy should decide on the direction of sustainable progress efforts and contribute collectively, in the larger national interest.

Gen Z Legal Awareness and Literacy

Gen Z demonstrates a degree of legal awareness, utilizing digital platforms for advocacy and advocating for social justice, diversity, equity, inclusion (DEI), as well as corporate social responsibility (CSR) initiatives and work-life balance/flexible work models [11,12]. They are driving change in the legal profession by using technology, challenging traditional legal structures, reshaping firm culture and client service to be more innovative, sustainable, and purpose-driven, and raising awareness about legal issues. They are also actively involved in grassroots movements and digital campaigns to tackle pressing issues, from gender-bias to human trafficking. It is necessary to use technology to work more efficiently and effectively, and they are pushing for more modern and innovative approaches in practice, as the public cannot afford a prolonged legal battle to obtain justice. Practical exposure through moot courts, legal clinics, and interdisciplinary initiatives is limited, for any meaningful contributions to an equitable global society. Individuals can influence positive social change, defend human rights, and contribute to the equitable distribution of justice in society with legal awareness and literacy. Alternative civil dispute resolution mechanisms such as arbitration, mediation, conciliation, and lok adalat must be considered for timely and cost-effective solutions due to the huge backlog of cases in various courts. 

Judicial literacy for Gen Z involves making them understand their fundamental rights and duties as enshrined in the Constitution, using digital tools for effective legal research, and engaging with the legal system through online platforms. It is essential to foster critical thinking to navigate information overload and algorithmic biases in today’s digital era within the evolving legal landscape. Strategies include practical online outreach, interactive digital content, and educational initiatives that promote resilience and ethical digital practices to foster a generation of informed citizens. It is necessary to find and evaluate information using online tools, social media, and AI-driven platforms for legal research by leveraging the tech-savviness of young adults [13,14]. Ethical digital engagement includes providing training on professionalism and ethical conduct when using virtual appearances, print and electronic communications, and social media in legal contexts. Strategies for implementation include developing digital content, such as blog posts, dynamic videos, multimedia presentations, PPT slideshows, and interactive platforms, to explain complex legal concepts and promote legal literacy. A structured training to develop resilience, emphasizing the critical evaluation of evidence sources, examination of witnesses, and analytical reasoning to combat excessive information and digital biases. Further, focused legal case studies, simulated courtroom exercises, workshops, and group discussions help youngsters develop self-control and handle complex legal challenges as opportunities [15,16]. Legal experts and influencers can share legal knowledge and practical advice on navigating the legal aspects and impacts to solve complex legal cases. Judicial literacy empowers Gen Z to advocate for their rights and contribute to a more just society, and equips them to handle legal challenges and opportunities by connecting the legal system with the community in the prevailing social, political, and administrative scenarios. 

Concluding Comments

Multiple perspectives provide legal values in the judicial system, and judicial literacy in Gen Z empowers skills of humanity. We must maintain the dignity of human existence through rational thinking, autonomous choices, moral actions, and a passion for the law and fairness. It is essential to develop a spirit of service and cleanliness, as well as good public behavior, through a series of impactful initiatives in educational institutions. Nurturing every learner’s unique potential by integrating academic rigor with holistic character development will foster creativity, emotional intelligence, and critical thinking in individuals. Preparing learners for knowledge tests and equipping them with the skills and mindset necessary to navigate future challenges by creating a productive learning environment in educational institutions enhances academic performance and overall development. It is essential to advocate for timely justice and human rights in capital punishment cases. The costs of trials to both parties and to the justice system must not outweigh the perceived societal benefits. An active judicial system maintains the fairness of the legal process, understanding the intricacies of law, and the association of Gen Z with the laws of the land, their practical implications, and issues associated with these laws, helps improve the existing reality of the judicial process and prospective legal developments. It is always better to constantly track the four Es: economy, equality, ecology, and essentials to ensure a strong nation and maintain order worldwide with the active participation of youngsters.
